These Terms of Use (the "Terms") are a legal agreement between you and The Top Finds ("we," "our," or "us"). They govern your access to and use of the website at the-top-finds.com and any related pages, newsletters, and feeds (together, the "Site").

Please read these Terms carefully. They include an arbitration agreement and class-action waiver (Section 13) that affect your legal rights. If you do not agree to these Terms, do not use the Site.

1. Eligibility

You must be at least 13 years old (or 16 if you are in the EU or UK) to use the Site. If you are between 13 and 18, you may use the Site only with the consent of a parent or legal guardian.

2. What the Site is

The Site is an editorial discovery service. We publish reviews, curated lists, and buying guides for consumer products. When you click an outbound link, you leave our Site and complete any purchase, account creation, or transaction on a third-party retailer's site under their own terms.

The Top Finds does not sell, ship, or fulfill any product, and does not process payment for any product. We are not a party to any transaction between you and a retailer.

3. Affiliate links and disclosure

Many of the outbound links on the Site are affiliate links. When you buy through an affiliate link we may earn a commission from the retailer. The commission never changes the price you pay and never determines whether a product is included in our editorial coverage. 4. Editorial content is opinion

Reviews, ratings, recommendations, and comparisons on the Site reflect the opinions of our editors at the time of publication and are provided for informational purposes. Specifications, prices, availability, and shipping terms change frequently; verify directly with the retailer before you buy. We are not your financial, medical, legal, nutritional, fitness, or product-safety advisor. Anything on the Site that touches health, finance, or safety is for information only and is not a substitute for professional advice tailored to your situation.

5. Intellectual property

The Site, including its text, layout, photography, graphics, code, and editorial selections, is © 2026 The Top Finds and its licensors. All rights are reserved except as expressly granted below.

You may quote up to 100 words of our editorial text with a clear credit and a link back to the source page. For anything more, email editors@the-top-finds.com to ask. Product names, logos, and images of third-party products are the property of their respective owners and appear on the Site for identification and editorial purposes only.

6. Acceptable use

You agree not to:

  • Reproduce, scrape at scale, frame, mirror, or republish the Site or any substantial portion of it without permission.
  • Use automated tools (bots, scrapers, crawlers) in a way that places an undue load on the Site, evades rate limits, or harvests data for resale. Search-engine and AI crawlers that obey our robots.txt are welcome.
  • Reverse engineer, decompile, or attempt to extract the source of any non-public part of the Site.
  • Probe, scan, or test the vulnerability of the Site, or attempt to bypass any authentication or rate-limit.
  • Interfere with other readers' use of the Site, or with the infrastructure that powers it.
  • Use the Site to violate any law or anyone else's rights, or to harass, defame, or deceive.
  • Misrepresent your identity (including impersonating a The Top Finds editor) when contacting us.

We may suspend or terminate access for anyone who violates this section, at our discretion and without notice.

7. Third-party retailers and links

Outbound links to retailers are provided for your convenience. We do not control, endorse, or assume any responsibility for the products, prices, content, privacy practices, or fulfillment of any third-party site. Your dealings with a retailer — including returns, refunds, warranties, and disputes — are solely between you and that retailer. See our Returns & Refunds page for a general overview.

8. Newsletter

If you subscribe to our newsletter, you consent to receive emails from us at the address you provide. We comply with the CAN-SPAM Act: every issue includes a one-click unsubscribe link. We may stop sending the newsletter at any time without notice.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED. WE DO NOT WARRANT ANY PRODUCT, RETAILER, OR THIRD PARTY THAT THE SITE LINKS TO. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; THOSE EXCLUSIONS MAY NOT APPLY TO YOU.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE TOP FINDS, ITS OWNERS, EMPLOYEES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR REPLACEMENT GOODS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). THIS CAP APPLIES IN AGGREGATE AND NOT PER CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT THE LAW ALLOWS.

11. Indemnification

You agree to defend, indemnify, and hold harmless The Top Findsand its owners, employees, and contributors from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Site, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any content you submit to us.

12. Governing law and forum

These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to the arbitration agreement below, any action that is not subject to arbitration must be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

13. Binding arbitration and class waiver

Please read carefully.Any dispute, claim, or controversy between you and us arising out of or related to the Site, these Terms, or our relationship (each a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Delaware (or by remote hearing if you prefer). Judgment on the award may be entered in any court of competent jurisdiction.

You and we each waive any right to a jury trial and to participate in a class, collective, or representative action. Disputes must be brought in your individual capacity only. If any part of this section is found unenforceable for a particular claim, that claim will proceed in court while the rest of this section remains in force.

You may opt out of this arbitration agreement within 30 days of first using the Site by emailing legal@the-top-finds.com with the subject "Arbitration opt-out" and your name. Either party may bring qualifying claims in small-claims court, and either party may seek injunctive relief in court for intellectual-property claims.

14. Changes to the Site or the Terms

We may add, change, suspend, or remove any part of the Site at any time without notice. We may also update these Terms. When we make material changes we will update the "Last updated" date above and, where required by law, give additional notice. Continued use of the Site after a change means you accept the updated Terms.

15. Termination

We may suspend or end your access to the Site for any reason, including breach of these Terms, without notice or liability. Sections that by their nature should survive (intellectual property, warranty disclaimer, limitation of liability, indemnification, governing law, arbitration, and these miscellaneous terms) survive any termination.

16. Miscellaneous

  • Entire agreement. These Terms, together with our Privacy Policy, Cookie Policy, and DMCA Policy, are the entire agreement between you and us regarding the Site.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce a right is not a waiver of it.
  • Assignment. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Notices. Notices to us must be sent to legal@the-top-finds.com. Notices to you may be sent to the address you provide or posted on the Site.
  • Headings are for convenience only and do not affect interpretation.
